Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Pro Weather, a hosted service that lets owners of Davis Instruments weather stations publish a weather website from their WeatherLink data (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pro Weather connects to your Davis WeatherLink account, ingests your station’s observations, and publishes them as a hosted weather website with live conditions, charts, records and optional severe-weather warnings. Features available to you depend on your plan and may change over time as we improve the Service.

2. Your account

• You must provide accurate information and are responsible for keeping your login credentials secure. You are responsible for activity that happens under your account.
• You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract.
• To connect a station you provide WeatherLink API credentials. You confirm you are entitled to use those credentials and the associated data. We store them encrypted and use them only to operate your site.

3. Free trial, subscriptions and billing

• New accounts include a 14-day free trial, no payment details required. If you do not subscribe before the trial ends, your site becomes inactive but your account and data are retained until you delete them.
• Paid plans are billed in advance through our payment processor, Stripe, on a recurring basis (monthly or annual) at the prices shown at checkout. Subscriptions renew automatically until cancelled.
• Prices are shown in euro. Applicable VAT or other taxes are added where required and shown before you pay.
• You can cancel at any time from your dashboard or the billing portal. Cancellation stops future renewals; your plan stays active until the end of the period you have already paid for.
• If a payment fails we may retry it and, after notice, suspend or downgrade the site until payment succeeds.

4. Right of withdrawal and refunds

If you are a consumer in the EU, you normally have a 14-day right to withdraw from a distance contract. Because the Service is supplied digitally, by subscribing and asking us to start the Service immediately you acknowledge that you may lose this right of withdrawal once the Service has been fully performed. The 14-day free trial lets you evaluate the Service before any payment is taken. If you believe you are entitled to a refund, contact us at hello@pro-weather.com and we will deal with your request in line with applicable law.

5. Acceptable use

You agree not to use the Service to:

• break the law or infringe anyone else’s rights;
• publish unlawful, misleading, infringing or abusive content, or content you do not have the right to publish;
• attempt to disrupt, overload, reverse-engineer or gain unauthorised access to the Service or its infrastructure; or
• resell or sublicense the Service except as expressly permitted by us.

6. Your content and data

You retain ownership of the content and station data you publish through the Service. You grant us the rights needed to host, process and display it for the purpose of providing the Service to you. You are responsible for the content you publish and for having the rights to it. How we handle personal data is described in our Privacy Policy.

7. Custom domains and third-party services

Paid plans may let you connect your own domain. You are responsible for owning that domain and for its DNS configuration. The Service relies on third parties (including Davis WeatherLink for data, and our hosting, payment and email providers). We are not responsible for the availability or actions of those third parties, and your use of them may be subject to their own terms.

8. Availability, changes and termination

• We work to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may perform maintenance or change features.
• You can stop using the Service and delete your account at any time.
• We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your account creates a security or legal risk. Where reasonable we will give you notice.

9. Disclaimers and weather data

Weather information provided through the Service is for general information only and must not be relied on for safety-critical decisions. Always consult official sources and the authorities for warnings and emergencies. The Service is provided “as is” and “as available” to the extent permitted by law; we do not warrant that data is accurate, complete or timely.

10. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer). Subject to that, to the maximum extent permitted by law we are not liable for indirect or consequential loss, and our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material we will give reasonable notice (for example by email or in the dashboard). Continuing to use the Service after a change takes effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Belgium, without affecting any mandatory consumer-protection rights you have in your country of residence. EU consumers can also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
